The Future of the Affordable Care Act

There is a lot of information circulating around the Executive Order issued by President Donald Trump titled, Minimizing the Economic Burden of the Patient Protection and Affordable Care Act (ACA) Pending Repeal. However, the immediate impact of this executive order is uncertain and affected parties would be best advised to await further guidance before reacting to the order.

Here’s what we know:

  • Right now, nothing has changed. The Affordable Care Act is still the law of the land.
  • If you have enrolled for coverage for 2017, be confident in your decision. Your policy cannot be cancelled. These are health insurance contracts governed by state law. The contract is for a year and the insurance company is not able to raise prices or do anything during the year.
  • If you do not have health insurance, you still have time to sign-up and get the benefits of the ACA while they are available. Open-enrollment for the ACA ends 1/31/2017.
  • If you can afford health insurance but choose not to buy it, you must pay a fee. You owe the fee for any month you, your spouse, or your tax dependents don’t have minimum essential coverage. The fee is calculated one of two ways and you pay whichever is higher:
    1. Percentage of income
  • 2.5% of household income
  • Maximum: Total yearly premium for the national average price of a Bronze plan sold through the Marketplace
  • 2. Per person

  • $695 per adult
  • $347.50 per child under 18
  • Maximum: $2,085
